These Terms of Service ("Terms") govern your use of Lensmark, operated by DAGNOSTICS LLC ("Lensmark," "we," "us," or "our"). By creating an account or using Lensmark, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
Lensmark is a history teller. You give it a photo or a question. For a subject Lensmark can verify, it can return a sourced history when research is available: what it is, where it stands, how old it is, who made it and why, and why it matters, when those facts are established. Identification is the means; the verified history is the product.
We ground our answers in retrieved sources and state honestly when something is uncertain or cannot be verified. We do not, however, guarantee that every answer is complete or correct. Lensmark is an informational tool. It is not a navigation service, a trip planner, a restaurant or itinerary recommender, or a substitute for professional advice.

You keep ownership of the photos, questions, and other content you provide ("Your Content"). You do not have to provide any content, and you choose what to provide.
To operate the Service, you grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, and use Your Content for the purposes of providing, securing, and maintaining the Service, and improving our models and results as described in the Privacy Policy. This license lasts only as long as we need it for those purposes; when you delete your account, we stop using it as described in the Privacy Policy, subject to reasonable time for deletion and to lawful retention.
You represent that you have the rights necessary to provide Your Content, and that it is lawful. If you give us feedback or suggestions, we may use them without obligation to you.
The Service, including its software, design, branding, and the compiled corpus of verified histories and narratives, belongs to us or our licensors and is protected by intellectual property laws. We grant you a limited, personal, non-exclusive, non-transferable license to use the Service under these Terms. You may not copy, modify, distribute, sell, or lease any part of the Service, and you may not use our name, logos, or branding without our permission.
Lensmark uses artificial intelligence and retrieved sources to produce its answers. Even though we ground answers in sources and flag uncertainty, outputs may contain errors, omissions, or outdated information. You are responsible for how you use them, and you should verify anything important before relying on it. Lensmark does not provide legal, financial, medical, safety, or other professional advice, and its outputs are not a substitute for a qualified professional.
The Service relies on and links to third-party services and content (for example, mapping and recognition providers, and external sources cited in our research). Your use of those services may be subject to their own terms, and we are not responsible for third-party content or for the availability or accuracy of external sources.
Lensmark has a free tier that needs no payment details. Beyond it, each plan includes a set number of identifications:
Prices are in US dollars and exclude any tax that applies where you are. When you reach your plan's included identifications we stop and tell you, rather than charging you more; you can wait for your plan to refresh, add a Week Pass, or change plan.
Payments are processed by Stripe. Card details go to Stripe and never reach Lensmark's servers. In the Lensmark iOS app, purchases are made through Apple's In-App Purchase and are billed by Apple to your Apple Account. Your payment details go to Apple and never reach Lensmark's servers.
Automatic renewal. Monthly and Annual renew automatically. On the web, Stripe charges your card at the start of each period. In the Lensmark iOS app, payment is charged to your Apple Account at confirmation of purchase, and again within 24 hours before each renewal, unless you cancel at least 24 hours before the current period ends. The Week Pass never renews.
Cancelling. You can cancel a subscription at any time, in one click, from Manage subscription on the web. Cancellation takes effect at the end of the period you have already paid for, and you keep access until then. If you subscribed in the iOS app, cancel in your Apple Account settings (Settings, then Subscriptions); cancellation takes effect at the end of the period you have already paid for. Deleting your Lensmark account cancels a subscription bought on the web, but a subscription billed by Apple must be cancelled in your Apple Account settings or Apple will keep charging you.
Refunds. The Week Pass is a one-time purchase and is not refundable once the identifications have been used, except where the law where you live requires otherwise, which it may. For purchases billed by Apple, refunds are requested from Apple at reportaproblem.apple.com and are decided by Apple. If something went wrong on our side, write to us at the support link below and we will put it right. Where we refund or reverse a purchase, the entitlement it granted is removed at the same time.
If we change prices or what a plan includes, we will update these Terms and tell you before the change applies to you.
You can stop using Lensmark at any time and delete your account. We may suspend or terminate your access, or remove content, if you materially or repeatedly breach these Terms, if we are required to by law, or if your conduct causes harm or liability to a user, a third party, or us. Where reasonable, we will give you notice and a chance to address the issue first, unless doing so would cause harm, violate the law, or compromise the security or integrity of the Service. Sections that by their nature should survive termination (including content licenses you have granted for already-shared content, disclaimers, limitations of liability, and dispute terms) survive.
To the extent permitted by law, the Service is provided "AS IS" and "AS AVAILABLE," without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any answer will be accurate, complete, or meet your needs.
To the extent permitted by law, Lensmark and its owners, employees, and providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, goodwill, or business opportunities. Our total liability arising out of or relating to these Terms or the Service is limited to one hundred U.S. dollars ($100). These limits do not apply to liability that cannot be limited by law, such as for gross negligence or willful misconduct.
If you use the Service on behalf of an organization, and to the extent permitted by law, you will indemnify and hold harmless Lensmark and its owners, employees, and providers from third-party claims, losses, and expenses (including reasonable legal fees) arising out of your unlawful use of the Service or your breach of these Terms.
These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-laws rules. Before filing a claim, you agree to try to resolve it with us informally by contacting dag@lensmark.ai. Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Broward County, Florida, and you and Lensmark consent to the jurisdiction of those courts.
We may update these Terms to reflect changes to the Service or for legal, regulatory, or security reasons. If we make material changes, we will provide reasonable notice, for example by posting the updated Terms with a new effective date or notifying you in the app. If you continue to use the Service after the changes take effect, you accept the updated Terms. If you do not agree, stop using the Service and, if you wish, delete your account.
